Important Information
1. BOOKING
* The booking will be confirmed upon receipt of a 50% deposit of the total accommodation cost. The deposit is payable within 48 hours after the booking is made, failing which the accommodation may be let to a third party.
* The reservation/booking dates will be held for a maximum of 48 hours ahead of receiving the payment.
* The balance of the total accommodation, including a refundable breakage charge of R5,000.00, shall be payable 14 days before arrival.
* Short notice bookings, being within 14 days of the booking dates, will require the total accommodation amount, including the refundable breakage deposit of R5,000.00, to be paid within 24 hours, payable immediately.
* All rates and amounts are in South African Rand.
* Electronic Funds Transfer (EFT) or a direct bank deposit is acceptable to the bank account detailed on the invoice.
* Receipt of the payment binds the guest, Owner and Management to this rental agreement.
* Should you wish to cancel your booking for a valid unforeseen reason after payment has been made, we will make every reasonable effort to re-let the accommodation for the period booked. If successful, we will refund your payment less a 25% handling fee; however, if we are unable to re-let the accommodation, the cancellation condition policy shall apply as set out herein.
2. PHOTO/STILLS AND FILM SHOOTS
* Different rates apply to events, photo/stills and film shoots - on request only.
3. CANCELLATION POLICY
* 15 days or more before arrival, the guest forfeits 75% of the deposit payment.
* 0 to 14 days before arrival, the guest forfeits 100% of the total accommodation payment.
4. ARRIVAL AND DEPARTURE
* The accommodation is available from 14h00 on the day of arrival. Guests are to confirm their estimated time of arrival.
* On arrival, guests are to sign in at the security gate/boom. Should you wish to arrive later than 17h00, prior arrangements need to be made; failing which, entry on that day may be denied.
* Silver Bay Villa Management will meet you on the premises for a short tour and key handover.
* Once the keys have been handed over, guests may come and go as they please.
* You will find a selection of attractions, activities, services and facilities within the surrounding areas, which are detailed in our guest instruction manual.
* The accommodation must be vacated by 10h00 on the day of departure.
* A late check-out is subject to availability and can only be confirmed on-site on the day of departure. Should you wish to guarantee a late check-out, you would be required to book an additional night.
* Guests shall be held liable for any incidents, losses, thefts or damages at Silver Bay Villa should the keys not be strictly handed over to Management or the host.
* On departure, please ensure that the premises and all the doors are properly locked up and the burglar alarm is activated. Kindly arrange with Management to hand over the key and the remote.
5. OCCUPANCY
* The number of persons occupying the premises is not to exceed the maximum number stated in the Silver Bay Villa description or as stipulated at the time of making the reservation, as per the booking form and invoice. Should the number of people exceed the number stated, you will be charged additional fees as determined by the house manager (acting reasonably), or excess guests will be asked to leave.
* Only guests whose names appear on the invoice will be permitted on the Silver Bay Villa premises. Any unauthorised persons that were not originally booked will be charged at a rate of R2,000.00 per person, and you undertake to pay such additional charge.
* All guests must act and behave reasonably and have consideration for the neighbours in the area. The Owners reserve the right to terminate the let of Silver Bay Villa if the guests or any person/s occupying the premises cause a disturbance or nuisance that may upset the peace and tranquillity within the neighbourhood.
* Music and noise levels are to be kept down to a level that is acceptable to all residents within the area and the development.
6. PROPERTY SAFETY & SECURITY
* Unauthorised persons/visitors are not allowed on the Silver Bay Villa premises.
* Please lock all doors during the day and at night.
* Ensure that the garage door is always closed and locked.
* Silver Bay Villa’s security alarm is to be activated whenever the premises are left unoccupied.
* Guests are to adopt vigilance and due care when occupying the premises and will be briefed on the Silver Bay Villa security measures upon arrival.
7. PETS & SMOKING
* This is a Non-smoking premises. Smokers are requested to always make use of ashtrays and “bud buckets” outside.
* No candles are permitted at Silver Bay Villa.
* Unfortunately, no pets are allowed.
8. BREAKAGES
* The guest and all persons occupying the premises, undertake to keep all furniture, all soft furnishings, fixtures and fittings, and all other electrical items in and around the premises in the same state and condition as at the commencement of their stay.
* Guests undertake to leave the premises in the state of cleanliness as when they arrived.
* Any tampering or interference with the TV and DStv settings, wiring, or rewiring of the amplifier will result in a call-out charge.
* A friendly request that books, magazines, and any other items that are available to guests inside the house are not to be removed from the premises.
* Kindly report any damages and breakages that may have occurred during your stay.
* The Owners of Silver Bay Villa shall be compensated by the guest/applicant for any damages and breakages, as well as any excess cleaning that is required. The decisions in this regard shall be within the sole discretion of the Owners and Management, acting reasonably.
9. RISK OF LOSS AND INDEMNIFICATION
* The guest/s agrees that all personal property, furnishings, personal effects, and other items brought into the premises by a guest, or their permitted guests and visitors shall be at the sole risk of the guest and occupants from any theft, damage, destruction all or any other loss and damages.
* The Owners and Management do not accept liability for any loss or damage to person or personal property, however caused, and are fully indemnified by the guests and occupants in this regard.
10. UNAVAILABILITY OF PROPERTY: -
* If Silver Bay Villa sustains physical damage during a rental term, causing it to be unsuitable or unsafe for occupancy, whether due to accidental damage, neglect, or unforeseen events, the Owners and Management shall not be held liable for any resulting inconvenience, loss, or expenses incurred by the guest.
* In such an event, the Owners will make reasonable efforts to assess the extent of the damage and, if possible, either repair the premises promptly or offer a replacement property that is similar in occupancy capacity, location, and value, subject to the availability of such a property.
* If a suitable replacement cannot be located, any payments made by the guest for unused rental periods shall be refunded, whereupon this agreement will terminate without further liability or obligations between the parties.
* This clause specifically addresses damage to the premises itself, and is distinct from other provisions related to broader circumstances or events beyond the Owners’ reasonable control.
11. MUNICIPAL SERVICES
* If municipal electricity or water services are disrupted to the premises, the guest shall immediately notify Management of such circumstance, and reasonable efforts will be made to restore such services.
* Should the event be beyond the reasonable control of the Owners and Management, the guest shall hold the Owners and Management harmless against any claims because of the extenuating circumstance
12. ASSIGNMENT OF SUBLEASE
* The guest shall not assign or sublease Silver Bay Villa or permit the use of any portion of the premises by any other person/s who is not a family member or a guest of the guest and included within the number of and as permitted occupants under this agreement.
* The premises shall not be used for any other purpose aside from a residential self-catering accommodation.
* Special functions, events, photo/stills, and film shoots are not permitted without prior written approval of the Owner.
13. INSURANCE DISCLOSURE
* The guest acknowledges and agrees that it is their sole responsibility to obtain and maintain adequate personal insurance coverage for the duration of their stay at the premises. This includes but is not limited to insurance for personal injury, medical aid, loss or damage to personal property, and any other potential risks associated with their occupancy and use of the premises.
* The guest confirms that they have secured or will secure sufficient insurance coverage and fully understand that they are financially responsible for any costs or expenses that may arise due to incidents not covered by their insurance.
14. FORCE MAJEURE
* The Owners shall not be held liable or deemed to be in breach of this agreement for any failure to delay in the performance of their obligations due to events or circumstances beyond their reasonable control. Such events include, but are not limited to, natural disasters, pandemics, acts of government, interruptions of electricity or water supply, and any other unforeseen events that prevent the Owners from fulfilling their obligations.
* In the event of a force majeure, the Owners reserve the right to suspend or terminate this agreement without liability or obligation to refund any payments made by the guest, except as may be determined at the sole discretion of the Owner. The Owner will make reasonable efforts to notify the guest of any such circumstances and their impact on the guest’s stay.
15. SEVERABILITY
* If any provision of this agreement is found to be invalid, illegal, or unenforceable for any reason, such provision shall be deemed severed from this agreement and shall not affect the validity and enforceability of the remaining provisions. The remaining provisions shall remain in effect and shall be interpreted in a manner that best achieves the original intent of the parties.
16. ENTIRE AGREEMENT
* This agreement constitutes the entire agreement between the Owners and the guest concerning the subject matter herein and supersedes all prior agreements or understandings, whether written or oral. No amendments or modifications to this agreement shall be valid unless made in writing and signed by both parties.
17. NON-VARIATION
* No variation, amendment, or modification of this agreement shall be valid or binding unless reduced to writing and signed by both the Owners or Management and the guest. Any waiver of any provision of this agreement by the Owners shall not constitute a waiver of any other provision, nor shall it affect the enforceability of the remaining terms of this agreement.
By proceeding with the reservation, you further agree to and acknowledge the terms and conditions stated herein.
