1. INTRODUCTION
1.1 Holiday Escapes is a business in the leisure, travel, accommodation, and hospitality industry that facilitates short-term rentals and experiences.
1. 2 The terms and conditions set out herein below shall regulate the nature of the agreement between Holiday Escapes and Holiday Escapes customers (“Holiday Escapes Customers”). The terms and conditions contained herein are deemed to be a consumer agreement in terms of the Consumer Protection Act 2008 Act No 68 of 2008 (the “CPA”), which finds application throughout this agreement and as such, the terms and conditions need not be signed in order to find application.
2. BOOKINGS, PAYMENTS, AND CANCELLATION
2.1 All bookings are to be made via the online booking platform on Holiday Escapes website or booking platforms.
2.2 Holiday Escapes cannot guarantee that accommodation seen online, will be available by the time a booking and/or reservation is attempted. All bookings are subject to availability and take place on a ‘first-come-first serve’ basis.
2.3. Bookings shall only be guaranteed upon receipt of a confirmation email from Holiday Escapes.
2.4. Rescheduling of bookings must be done 30 days prior to arrival date, any late request(s) will not be honoured. In the event that a Holiday Escapes Customer fails to make use of their booking, the Holiday Escapes Customer will forfeit their payment.
2.5 Rescheduling of bookings may be subject to administration fees and price increases and/or decreases dependent on the location and date of reschedule. Any subsequent changes that result in a price increase must be settled in full before confirmation of such booking is guaranteed.
3. PAYMENT
3.1 All payments are to be made via Holiday Escapes online payment platform and shall be subject to the terms and conditions of Paystack Payments Limited (“Paystack”), the payment platform’s service provider.
3.2 Paystack employs advanced encryption technology, including Secure Socket Layer (SSL), to protect all transactions. No card details are stored on Holiday Escapes website. For further details on Paystack’s security measures and policies, users may visit: https://paystack.com/za/compliance.
3.3 Customer details will be securely stored by Holiday Escapes separate from card details, which are entered directly by the client on Paystack’s secure platform. Holiday Escapes does not process or store sensitive payment information, ensuring all payments are handled in compliance with Paystack’s security and privacy standards.
3.4 The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. The transaction currency is South African Rand (ZAR). For additional details regarding Paystack’s terms of service, please visit https://paystack.com/terms.
4. CANCELLATIONS
4.1 All cancellation requests for confirmed bookings are subject to the following provisions and section 17(3) and (4) of the CPA –
4.2 The property maintains a strict Cancellation Policy. Guests are expected to comply with the relevant
terms and conditions.
4.3 Only bookings made through the HolidayEscapes.net website are eligible for a refund. Unfortunately, as some booking platforms do not offer refunds at all, Holiday Escapes cannot process refunds for bookings made outside of our official website, HolidayEscapes.net;
4.4 Confirmed bookings made through the HolidayEscapes.net website, cancelled 30 days or more in advance of the arrival date shall be refunded in full;
4.5 Confirmed bookings made through the HolidayEscapes.net website, cancelled less than 30 days prior to the arrival date shall not be refunded; alternatively, a cancellation penalty of 100% of the booking price shall be levied;
4.6 All confirmed bookings must be cancelled in writing.
4.7 Should Holiday Escapes cancel a confirmed booking for any reason whatsoever, the Holiday Escapes Customer shall be given the option to reschedule the booking, free of charge, or to be refunded in full.
4.8 In the event of any cancellation or when funds need to be reversed back to a credit card, Holiday Escapes reserves the right to not refund the card transaction fees. This policy applies to all purchases and bookings made through our service.
4.9 Please note that we do not refund early departures and/or cancellations which fall outside of the cancellation policy.
5. DURING YOUR STAY
5.1 Some properties strictly maintain access control. Guests are kindly requested to complete the required information and provide it to your host so that arrangements can be made for your access with applicable complex management.
5.2 Check In/Out:
• Check-In Time varies from 2 pm onwards and Check Out Time from 10:00 am.
• Please inform your host of your expected arrival time in order to arrange access to the property.
• Please report any faults upon arrival. If you are checking in ‘after hours’ please report any faults by 9:00 am the following day.
5.3 Arrival: Kindly see the Guest Access Guide for instructions on travel, and access to the property upon arrival.
If you have booked through Airbnb, please see the Directions and Check-in features on the Airbnb App for instructions on travel, and access to the property upon arrival.
5.4 We reserve the right to evict for unruly behaviour and overcrowding without refunding.
5.5 Pets are only permitted at specific properties with prior approval. The listing will clearly state whether it's a pet friendly property.
5.6 Departure: Kindly ensure that ALL doors and windows are locked, and if needed, return the keys to the same collection lock
box at the entrance to the property.
5.7 Extra cleaning fees may be charged as required.
5.8 Guests agree to abide by the Body Corporate's strict Rules and Regulations at all times.
5.9 The building's quiet hours are between 10pm and 9am. Guests who breach these times will be liable for an automatic fine of R3000. The property reserves the right to retain guests' Refundable Deposits should any guest be found guilty of such transgressions. Guests who fail to comply with these regulations will be evicted from the property.
5.10 Body corporate fines are payable within 24 hours of issue. Guests agree to payment of such fines irrespective of their reasoning for the fine being issued. Please note that fines can amount to more than R5000 and may result in Guests having to immediately vacate the premises.
5.11 The owner and staff of the property will not be held liable for any damages, loss and injuries of guests.

6. EXEMPTION FROM AND DISCLAIMER OF LIABILITY
6.1 Sections 49 and 22 of the CPA state that any notice and/or term indemnifying a supplier, in this case Holiday Escapes, must be drawn to the attention of the consumer, in this case the Holiday Escapes Customer. Therefore, the Holiday Escapes Customer is hereby notified that Holiday Escapes shall not accept liability for any losses and/or damages, whether direct or indirect, special or consequential, in the following circumstances –
6.2 Any death, injury or illness sustained or suffered by any person. For theft, loss or damage to any property, whether allegedly due to the negligence of Holiday Escapes, its officers, employees, agents, affiliates, and partners or arising from the use of any facilities supplied or made available by any of them.
6.3 Further to the above-mentioned, the entry/access to and use of a property, its amenities and/or participation in and to any of the activities available on the premises and/or land on which the property is situated, shall be at the own risk of the Holiday Escapes Customer. Holiday Escapes and/or its employees and/or agents and/or its successors in title shall not be liable for any damages, loss, theft, injury, accident or death suffered by any person, howsoever caused.

7. FIRE LIABILITY
7.1 Fire is a major environmental, human and livelihood threat. Anyone caught lighting, using or maintaining a fire or attempting to light, use or maintain a fire in areas other than those demarcated by Holiday Escapes will be in contravention of the National veld and Forest Fire Act 101 of 1998 and will be liable for fines as well as all costs incurred to extinguish the fire, including any legal costs.

8. DAMAGE, THEFT, AND COMPLIANCE
8.1 Guest Responsibility: By booking and staying in one of our beautiful Homes, guests agree to take full responsibility for maintaining the condition of the property and any property within it during their stay.
8.2 Damage and Breakages: Guests will be held liable for any damage, breakages, or loss of property that occurs during their stay, whether caused intentionally or as a result of negligence. Guests must immediately report any damage or breakages to Holiday Escapes. With some of our properties, a Refundable Breakages Deposit is required. Payment is collected in the form of an electronic bank transfer prior to guests' arrival. If you have booked through Airbnb, please don't worry about this payment as it has already been taken into consideration at the time of making your reservation.
8.3 Theft: Any items belonging to Holiday Escapes that are removed from the premises without authorisation will be considered stolen. Holiday Escapes reserves the right to report such instances to law enforcement and to seek reimbursement for any missing items.
8.4 Violation of Booking Rules: Guests must adhere to all rules provided by Holiday Escapes at the time of booking and during their stay. Failure to follow these rules may result in penalties, including but not limited to early termination of the stay without refund.
8.5 Liability and Debit Authorisation: Holiday Escapes reserves the right to charge the payment card used for the booking to cover the costs of any damage, breakages, theft, or violations of booking rules, including any additional cleaning fees if the property is left in an excessively dirty state. By accepting these terms and conditions, guests authorise Holiday Escapes to debit their payment card for such costs as deemed necessary.
8.6 All departures are checked by housekeeping. Guests will be liable for the replacement value of any breakages and damages, and agree to pay such value as quoted within 2 working days following their Departure Date.
9. HOLIDAY ESCAPES' USE OF WEBSITE POLICY
Terms
By accessing the website at https://wwwholidayescapes.net, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. Thanks for choosing to stay! Please ensure that you read and fully understand the following House Rules and Terms & Conditions which have been compiled in line with the various Complex's Body Corporate Rules & Regulations. Guests are required to adhere to the following guidelines, and the Body Corporate Rules and Regulations. If anything is unclear, please contact your host who will explain in further detail to avoid any misunderstandings during the course of your stay.
• Much effort has been put into making these property a lovely space for guests to enjoy. Please be respectful of the property as it is a holiday home and not a hotel. Please treat it with the same respect as you would your own home.
• Please ensure that you maintain a good level of cleanliness throughout your stay. Please throw garbage into the bins and ensure that food is not left lying around.
• This is an eco-friendly home! Please make sure you switch off aircons, lights, fans or any other small electrical appliances when they are not in use/upon leaving the property.
• While some buildings are pet-friendly, this is subject to approval prior to booking. Please note, out of respect for future guests, we kindly request that pets aren't permitted to sleep on the furniture and beds. While it goes without saying, guests are required to ensure that their pets do not urinate/defecate within the property, within the building's indoor communal and/or against any of the building's walls. Should any extenuating circumstance arise, guests are required to immediately clean and disinfect the affected area.
• Monkeys frequent the area. Please keep the windows and doors closed to prevent the monkeys from entering the property when you aren’t around. Guests are urged not to feed the monkeys please.
• Please keep any balcony furniture and cushions undercover at night and/or when they're not in use to protect from sun/rain damage.
• Please don’t sit on the couches with wet clothes/costumes as it may damage the fabric and furniture.
• Please open the bathroom windows when showering to let the humidity out.
• In the case of any accidental damage, the issue will be assessed internally to determine any deduction/repair costs.
• Please DO NOT touch/reset the WIFI Router. It is extremely stable and very sensitive. If it is reset, it will initiate factory settings and a technician will have to be called out. Guests who fail to comply with this request will be charged for this service fee. If you experience any issue whatsoever, please contact your host for assistance.
• Kindly note that most of our properties are non-smoking properties.
• Where properties are not serviced, cleaning services must be arranged prior to arrival and any associated costs will be borne by the Guest booking.
• Parties and Events are strictly prohibited (not allowed!) If guests are found to have had a party which results in extra cleaning, guests will be responsible for extra cleaning charges and in the unfortunate event of any disruptions alerting neighbours, GUESTS WILL BE ASKED TO VACATE THE PROPERTY IMMEDIATELY.
• We hope you have lots of laughter and fun times during your vacation! However, out of respect for the caretakers and residents, guests should be mindful of noise. Noise is not permitted before 9 am, and after 10pm (Monday to Sunday.) Guests who breach these times may be evicted and liable to a fine.
• If guests are suspected of carrying and/or using illegal drugs of any kind, the authorities will be engaged, and GUESTS WILL BE ASKED TO VACATE THE PROPERTY IMMEDIATELY.
• Upon booking, Guests will be asked to complete their Guest Registration and to provide copies of each guest/s Identity Document. Please note that only guests who have booked at the premises are permitted to visit the property with only the maximum guests indicated allowed in the property at any given time.
• Guests are required to provide their vehicle registration number which will be sent to the complex's security to enable guests' access.
• Guests’ requests for early arrivals/delayed departures are fully dependent on availability. The properties have a high occupancy rate therefore availability will be confirmed around 9:30pm on the evening prior to your date of arrival/on the morning of departure.
• Kindly ensure that all doors and windows are locked when you're out/upon vacating the premises.
• Never leave children without any adult supervision at the property. Guests are fully responsible for the safety and security of their children at all times.
• Guests are responsible for ensuring that any visitors comply with these House Rules.
• Any additional overnight Visitors must be approved in advance, and are subject to an additional fee as
noted in the properties rates.
• A 15% service fee is charged on all bookings. Kindly note that this service fee also applies to cancellations, irrespective of the reason for cancellation, and/or cancellations which may involve circumstances that are centred around natural disaster, death and/or force majeure, irrespective of the situation. Kindly note that this 15% service fee is deducted over and/or above any applicable refund
amount, and only in circumstances where a refund may be applicable in line with the relevant cancellation policy/terms at the time of your booking.
• Guests' occupation of the property, in line with the period of their reservation, will be deemed as their agreement to abide by the property's aforementioned House Rules, and their acceptance of the property's aforementioned Terms of Conditions.
