Important Information
Terms and Conditions of Residence
Words importing:
a. Any one gender includes the other gender.
b. The singular includes the plural and vice versa; and
c. Natural persons include created entities (corporate or unincorporated) and the state and vice versa
The guest, by signing the registration form, warrants that he is duly authorized to sign and bind his principal as well as each member of his accompanying party, to these terms and conditions of residence and failing such authority, he agrees to be personally liable for all amounts arising from his residence at the hotel, as well as the residence of any member of his accompanying party.
The guest hereby undertakes to vacate the room(s) no later than 10h30 on the date of departure and shall return the key(s) to the reception upon vacating. Failure to comply with this obligation may render them liable for additional charges or penalties as may be determined at the sole discretion of the hotel.
The guest and his principal agree to pay to the hotel, no later than at the time of departure (unless prior written arrangement have been made) for the period of residence, together with any amount incurred by the guest and his accompanying party in respect of food, beverages, any other commodity or service charged by the guest to the room and/or value added tax (if applicable).
A certificate from the hotel management, whose authority need not be proved, shall constitute prima facie proof of the indebtedness of the guest and/or his principal and/or member/s of his accompanying party, and of the particulars therein for all purposes including any action instituted by the hotel against the guest and/or his principal and/or members of his accompanying party.
The guest agrees that after his departure, the hotel may possess goods left behind and authorizes the hotel after giving one month’s notice to the address registered by the guest, of its intentions to do so, to sell same privately or publicly, at the hotel’s discretion at such price as the hotel may determine and offset proceeds of such sale against possible indebtedness or to hold such process for a period of three years pending any claims by the guest for those proceeds, failing which they shall be deemed as having been donated to the hotel.
The owner, its agents and/or employees is not liable for:
a. any loss or damage to the property or possessions of any guest, resident or visitor, whether such damage was caused by fire, theft or otherwise, or by the negligence or the wrongful act, or omission, of the owner, its agents and/or its employee.
b. The death of or any personal injuries of whatsoever nature sustained by a guest, resident, or visitor, whether such death or injuries were sustained by the negligence or wrongful act, or omission of the owner, its agents and/or its employees and/or by the defective functioning of any apparatus.
The parties hereby select, as their respective domicilia citandi et executandi for all purposes arising from or in connection with this agreement—including, but not limited to, service of legal process, notices, and any other documents or communications of whatever nature—the addresses indicated on the reverse hereof or any address otherwise communicated in writing between the parties.
All persons entering the premises owned and/or managed by the companies/organizations referred to hereinafter accept that they do so entirely at their own risk. Petite Provence shall not be liable for any loss or damage, howsoever occurring, to the parties’ person or property, even though the parties are aware of the protection which the law affords them and their dependants in relation to the injuries or loss suffered in these circumstances. The parties hereby waive, on their own behalf and on the behalf of their dependants and those whom they legally represent, any claim which they may have arising out of injury, loss or damage occurring to themselves or their property whilst on the property.
It is expressly recorded that the right of admission to the premises is hereby reserved by Petite Provence B&B. The proprietors and/or management shall have the sole discretion to refuse entry or accommodation to any person. Furthermore, the proprietors and/or management reserve the right to evict or remove any guest, resident, or visitor from the premises whose conduct, behaviour, or actions are deemed, in the sole and absolute discretion of management, to be objectionable, disruptive, unlawful, or contrary to the interests, safety, or well-being of other guests, residents, staff, or the establishment itself. Such removal shall not constitute a breach of contract or give rise to any claim for damages or refund.
The parties’ consent to the jurisdiction of the magistrate’s Court having territorial jurisdiction, notwithstanding that such proceedings are otherwise beyond its jurisdiction. This clause shall be deemed to constitute the required written consent conferring jurisdiction upon the said court pursuant to section 45 of the Magistrate’s Court act, 1944, provided, nevertheless, that any party shall have the right at its sole option and discretion to institute proceedings in any other competent court.
Privacy Policy
The proprietors of Petite Provence B&B acknowledge and respect the privacy of all guests and visitors. The personal information collected, including but not limited to name, address, and credit card details, shall be utilised solely for the purposes of providing accommodation and services, and shall not be disclosed, sold, or transferred to any third party, save as required by law.
The proprietors undertake to employ all reasonable measures to ensure the protection of guests’ personal and payment information. Security protocols are in place to safeguard such information against unauthorised access, use, or disclosure. Under no circumstances shall personal or financial data be transmitted over public channels in an unencrypted or otherwise unsecured manner.
Petite Provence engages the services of a third-party payment processor, PayBridge, for the handling of card transactions. For further information regarding PayBridge’s privacy policy and data processing practices, reference is made to “site.nightsbridge.com/privacy-policy/.”
This privacy policy is binding upon all guests, residents, and visitors by virtue of their entry onto the premises and/or by making use of the services provided by Petite Provence B&B.
