NGHALA SELF-CATERING HOLIDAY HOME BOOKING RENTAL AGREEMENT TERMS AND CONDITIONS 1)BOOKING PARTICULARS:a)A breakage / damage deposit of ZAR 2500.00 will be charged before the form for key collection from Field Security will be issued. 2) NUMBER OF GUESTSa)If, without the knowledge or consent of the owner, additional persons stay at Nghala self-catering holiday home, a claim of 25% of the rent per additional person will arise and become due and payable immediately. This claim may be deducted from the deposit. b)Bedrooms that are not rented out / in use will be locked.3)CANCELLATION POLICIES: a)In the event of a cancellation, the management of Nghala are entitled to release the property for rent or lease to others. b)If the tenant leaves / vacates Nghala holiday home before the check-out date of the rental period, the contract will remain binding for the full period and all monies will remain payable. There will be no refund of any rental amounts.4) DEPOSIT A breakage deposit of R2 500.00 will be charged . Nghala self-catering holiday home has valuable equipment and items in it and the deposit serves to compensate for any accidents, breakages or damage caused by the tenant. The following rules apply to the damage / breakage deposit.a) Complaints about the inventory and possible existing damage will only be accepted up to 3 hours after arrival. This must be reported to management immediately via email at [email protected]. Photographs of damaged items should be included in your report. b) The holiday home will be checked upon final cleaning. At that time the caretaker will determine any breakages, loss or damage to property. These damages, breakages or loss will be reported to management.c) If the holiday home has been left in good order and no loss, breakage or damage has been found, the breakage / damage deposit will be refunded no longer than 3 weeks after the stay.d) The deposit will be used to cover any damages, loss or breakages should they arise. If the breakages, loss or damages exceed ZAR 2 500.00 the balance will be for your account and will be payable via bank transfer only (no cash accepted). An invoice for the excess cost of damages /loss/ breakages will be emailed to you and will be payable immediately on receipt thereof. e) A conflict about damage, loss or breakage is a conflict between tenant and owner. The owner will have the final say and decides on the deposit. Only replacement quotes by management of Nghala will be acceptable. f) Lost or damaged items that you are aware of must be reported in writing to [email protected] as soon as possible. 5) RELEASE, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT a) LIABILITY OF THE TENANT 1) The principal tenant (herein referred to as the tenant), his/her fellow tenants and/or all his/ her visitors must, at all times, use the accommodation provided with the utmost care. Respect to the home and its surroundings must be shown at all times. 2) The tenant is liable for any damage caused by him/her, his/her fellow tenants and/or any visitors. The home and its surroundings will be checked once the tenant, his/her fellow tenants and/or visitors have vacated the premises. If upon this inspection any damage, breakage or loss is discovered the tenant will still be held liable and must comply with the management of Nghala’s decision on the matter. 3) Nghala self-catering holiday home’s house rules must be adhered to at all times. A copy of the house rules are provided and form part of this agreement. 4) The tenant must ensure that he/she and his/her fellow tenants and/or visitors do not disturb the neighbours in any manner whatsoever. No loud music, shouting or screaming is allowed. In the event of an infringement, the management of Nghala holiday home have the right to evict the tenant and his/her fellow tenants and/or his/her visitors from the home without any refund of the rent or deposit. WARNING: NO NOISE POLICY ZAR 3 500.00 Marloth Park has a ‘no noise’ policy which came into effect on 01 February 2021. Dan Modiga, the Law Enforcement Officer of Marloth Park enforces this policy. If the Law Enforcement Officer is called out for a noise complaint the tenant will be fined ZAR 3 500.00 on the spot and on second call out you will be ordered to leave Marloth Park. 5) Nghala self-catering holiday home is a NO SMOKING home. Smoking is only permitted in the boma area and cigarette butts / buds must be disposed of in a water filled bottle. 6) The tenant is responsible for every fire that is ignited at Nghala self-catering holiday home. Every fire must be supervised at all times and completely extinguished with either sand or water. The tenant is liable should any damage whatsoever be caused to the property by a fire ignited by him /her or his/her fellow tenants and/or visitors. The use of candles is strictly prohibited. 7) The tenant agrees that he/she will enter and use this accommodation entirely out of free will and voluntarily participates in all activities undertaken in and around the holiday home (including, but not limited to – interactions with animals, use of the splash pool, and walking around the premises) including the use of all facilities and equipment. 8) Every tenant accepts the risk of loss, injury, illness, damage, death or any other damage to people or property that may result from this use or participation. 9) The tenant warrants that Nghala self-catering holiday home , its owners, management, employees caretakers and any other representatives will not be held responsible or liable for any loss, injury, damage or death to any persons or any other damages to property suffered by him/her , his/her fellow tenants and/or his/her visitors howsoever caused.b) LIABILITY OF THE OWNER The owner is not liable for any loss or any other claim by the tenant or his/her fellow tenants or his/her visitors regarding, but not limited to, the following: 1) Liability for personal injury or death of the tenant or his/her family member or relative, or his/ her fellow tenants or his/her visitors sustained directly or indirectly in or about Nghala self- catering holiday home from whatsoever cause. 2) Liability for loss or damage to personal belongings howsoever caused. 3) Liability for change in any travel arrangements. 6) UPON DEPARTUREa) We will make sure that the property is in a highly acceptable condition upon your arrival. The holiday home must be left as you found it. This means the following:* The house is tidy and everything is in its place. * Bring in anything you may have taken outside. Eg: braai grid etc.* The dishes are clean and have been returned to the cupboards. * If you have any left-over food that you are leaving behind please ensure you put it in the fridge and not in the microwave or in the cupboards. * Empty all dustbins and put the waste bags in the cage provided at the bottom of the driveway. * Turn off the stove at the wall.* All lights are switched off.* All air-conditioners are switched off. A penalty of R250 per unit will be deducted from the breakage deposit if left running.* Close all windows and lock screens and all doors.* Secure the pool cover on the splash pool.* Set the alarm. A penalty of R 2500 will be deducted from the breakage deposit if not set.b)A cleaning fee of ZAR 1000.00 will be charged and deducted from the damage/breakage deposit if the property is left untidy, messy or disorganised. 7) NGHALA’S HOUSE RULES A copy of the house rules together with this document will be sent to you for signing prior to collection of the keys from Field Security.____________________________________________________________________________________________________________NGHALA HOUSE RULES* Check-in after 14h00 and check-out before 10h00. Keys to be collected from Field Security using form provided.* Strictly No smoking in the house, on the patio or viewing deck. Smoking only permitted in the boma.* No candles in the house.* When leaving the house for however long, make sure that all windows are closed, window screens are locked, doors are locked, and the alarm is on.* Keep all aluminium window mosquito nets locked at all times and do not remove the keys.* The water is safe for bathing/showering. Only drink water from the small tap in the kitchen as the water is from the borehole.* Do not run the air-conditioners lower than 22 degrees and do not run all day. Make sure to turn all air- conditioners off when leaving the house for any period of time. * Please note the noise rules in Marloth Park. Keep noise levels low at all times.* Do not use bath towels as beach/swimming towels. These are to be provided by yourselves.* Do not deposit feminine hygiene products, wastepaper or any non-biodegradable items in the toilets as the house uses a septic tank system. * Pool safety is of utmost importance ! The following rules apply with regards to the splash pool: * Floors are slippery when wet. Be careful when coming out of the splash pool. * Do not jump or dive into the splash pool. * Do not use any glass containers or bottles in the splash pool. Broken glass can cause serious injury. * Children must be accompanied by an adult at all times. Child supervision is of utmost importance ! * The pool cover must be taken care of when removed from the pool. Ensure that the pool cover is put back on when the pool is not in use.* Fire may only be made in the boma area and in the built-in braai. Do not make a fire in the boma if it is windy. Every fire must be supervised at all times and completely extinguished with either sand or water. The use of candles is strictly prohibited. * Do not leave any food unattended outside as baboons and monkeys are around looking for food and are quick at taking it. They very easily become aggressive.* Do not feed the animals. They are wild animals and can be extremely dangerous. * Pets of any sort are not allowed at Nghala.* Strictly no loud music or parties are allowed. * It is forbidden to walk, drive or cycle in the parkland to the right and at the back of the house. * For safety reasons, walking and cycling in Marloth Park are prohibited between 18h00 and 06h00. There have been visits by lions, leopards and hyenas from Kruger National Park. UPON DEPARTURE:* Rubbish bags must be deposited in the cage provided at the end of the driveway. Do not leave them outside the back door.* Do not leave food in the cupboards, on counters or in the microwave when vacating the house. Leave all consumable items in the fridge. * All air-conditioners must be switched off. * The gas stove must be turned off at the wall. * Ensure all taps are closed.* All lights must be turned off. * All items must be brought into the house. Eg: braai grid * All windows must be closed and screens must be locked.* All doors must be locked.* The pool cover must be securely put back on the splash pool.* The alarm must be set. * Keys to be dropped off at Field Security.WARNING: Baboons can enter the house if windows, window screens or doors are left open. Whenever you leave the house it is your responsibility to ensure all windows are closed, window screens are locked and door screens and doors are locked !
