Important Information
TERMS AND CONDITIONS
1. The Guest hereby agrees to the occupation of the premises for use as short-term accommodation for the period as set out as per the maximum number of guests allowed on the listing.
2. The Guest who makes the booking hereby warrants his/her authority of behalf of all persons included in the booking to agree that all such persons shall be bound by the terms and conditions herein.
3. It is the Guests responsibility on check in to inspect the property and report any defaults, broken and or missing items to the Landlord or Property Manager, failing which the property shall be deemed to have been handed over in good order and condition. The Guest undertakes to keep the contents and equipment in the same condition as at the commencement of occupation and confirms that that the cost of any missing / broken / damaged items will be deducted from the security and breakages deposit. Should the damages/breakage amount exceed the breakage fee the Guest will be liable for all and any costs over and above this amount.
4. It is recorded that the entire Premises, including any carpets and upholstery, will be clean and in good order on the date of occupation. The Guest undertakes, on termination, to deliver the Premises in the same good order. Should the Landlord or Property Manger upon inspection, find that the Premises is not clean and in the same good order as at the date of occupation, (fair wear and tear accepted) they will engage the services of professional cleaners and/or carpet cleaners, at the cost of the Guest and deduct such cost from the refundable security and breakages deposit. The Guest undertakes to keep the property in a clean, tidy and sanitary condition.
5. Should the Guest find anything that seems to be faulty with the premises, the Landlord or Property Manager will have within reason, 24 hours from receipt of the Guest’s notification of this problem to fix the faults. Should the guest decide not to accept the 24-hour leeway and check out on their own accord. The establishment cannot be held liable to refund all or part of the rate paid by the guest.
6. The accommodation is booked by the Guest as per the description, images and details presented to the Guest. Establishment cannot be held as the responsible party should the Guest be unhappy with the Guest’s choice of premises.
7. A damage deposit of R 1 000.00 will be payable via EFT directly to the establishment, Landlord or the Property Management company prior to arrival. Should there be no breakages or damages, this deposit will be released no later than 15 working days after the date of departure. Should any damages or breakages be found, the monetary value will be deducted from the damage deposit. If the total amount of the damages exceeds the damage deposit the balance of the amount shall be deducted from your credit card. Failing this the cost of damages exceeding the deposit held and no credit card details supplied, the matter shall then be between the Guest and the Landlord or Property Manager. Should you find anything on arrival that is broken, damaged or not in a good working condition, you are to report it on the same day to avoid any discrepancies and this being claimed against your breakage deposit. If the Guest has not notified the establishment within 24 hours of the arrival date of any defects in the premises, the Guest shall be deemed to have acknowledged that the premises were received in a good order and condition.
8. The premises are let for the sole use as a private residence only and any commercial activity must be expressly authorized prior to occupation. If any unauthorized commercial activity occurs, the rental rate for the period will be doubled (2 times) the agreed rate. The number of guests is not to exceed the number set out as the maximum capacity allowed on the listing. If more guests than were paid for on the booking site are found in the property, all guests will be asked to leave the premises immediately with no refund. The Guest shall not sublet or part with possessions of the premises or part thereof.
9. Under no circumstances are any parties allowed at the property without prior written permission.
10. Please note that there is no smoking permitted in the property. A fine of R1000.00 will be levied. Guests must please smoke outside.
11. Please note that this property is pet friendly by prior arrangement only.
12. Please ensure that all doors and windows are closed and locked when departing from the premises at all times.
13. The Guest indemnifies the Landlord and or Property Management Company and or staff from any constructional work being carried out in the vicinity of the property.
14. The Guest shall not have any claim of any nature against the Landlord and or Property Management Company and or staff in respect of any theft, loss, damage or injury to the guests whether due to any negligence on the part of the Landlord, their agents, their staff or otherwise, by reason of any latent patent defects in the premises or fire in the premises of theft from the premises, or by reason of the premises or any part thereof being in a defective condition or state of disrepair or any particular repair not being effected by the Landlord timeously or at all or arising out of any defect in the water, gas or electricity supply to the Premises or arising out of vis major or any other cause wholly or partly beyond the control of the Landlord or arising from any other cause whatsoever.
15. The Guest undertakes to maintain reasonable noise levels at the property at all times as excessive noise may be in contravention of the laws of the Republic of South Africa, body corporate rules and/or the municipal by-laws. In the event of the Guest transgressing the body corporate rules and/or the municipal by-laws, he/she accepts that this may lead to the short-term lease being terminated immediately by the Landlord, his Property Manager or staff and in which case all monies paid will be forfeited.
16. The cost of replacement of all keys, tags and remotes not returned to the Landlord or his Property Manager will be deducted from the refundable security and breakages deposit. This could include the replacement of all security keys to re-secure a complex. The Guest is not permitted to make any duplicates of any keys or remotes in respect of the premises.
17. In the event of the Guest vacating the premises prior to the contracted departure date for any reason whatsoever, he/she shall have no claim for the refund of any rental monies.
18. In the event of the Guest breaching any term of this agreement, the Landlord shall be entitled to terminate this agreement forthwith and the Guest undertakes to immediately vacate the premises. Any breach by the Guest shall constitute a material breach for the purposes of any proceedings taken against the Guest.
19. The Guest agrees that the Landlord and/or their Property Manager or representatives shall be entitled to inspect the premises upon reasonable notice at all times during the rental period.
20. Guests must please bring their own bath and beach towels.
