Conduct Agreement
These clauses are in place not only to help us maintain the villa to the highest standard of luxury and care, but also to ensure that our villa is the right fit for you. We take them very seriously, because they allow us to protect the quality of the space for your stay and for every guest who comes after you.
We’re proud to offer a beautifully maintained, thoughtfully designed villa, and we expect all guests to treat it with the same level of care and respect.
We also take our relationship with our neighbours seriously. This is a peaceful area, and it’s important to us that both you and our neighbours can enjoy a quiet, respectful environment throughout your stay.
These Booking Conditions outline the Terms of your stay with us. Please review them carefully before signing.

2. Identity Documents
• Each guest is to provide a copy of their ID or passport prior to arrival. You’ll find an option to upload a copy further down, next to your digital signature in this document. Please note that this is a legal requirement in South Africa, and we may decline access to the property if this is not received prior to arrival.
3. Confirming a Booking
• No booking is confirmed until full payment has been made, a Damage Waiver is in place, the signed Conduct Agreement and ID or passport copies have been received.
4. Payment of Balance
• A 50% deposit is needed to secure your dates and the balance payment is due 30 days before arrival.
5. Damage Waiver
• A Damage Deposit Waiver via Truvi - https://truvi.com/ - at a small additional cost, is mandatory.
• If there are any damages, losses, or other costs incurred during the stay, the guest (or booking agent) will be notified within 4 working days of departure, once the property has been inspected.
6. Cleaning Service
• One weekday housekeeping service is included for every 4 night stay.
• Additional cleans are available at an additional fee.
• Excludes personal laundry/cooking (this can be arranged directly with the housekeeper at an agreed rate).
7. Included Services
• Electricity, water, council rates, satellite TV, uncapped WiFi, pool and garden maintenance where applicable.
• Linen, bath towels and beach towels, hairdryers, shampoo, hair conditioner and liquid bath soaps are provided.
8. Arrival & Departure
• Check-in: after 2 PM | Check-out: before 10 AM
• Earlier arrival and/or later departure requests are subject to availability and can only be confirmed the day prior.
• A guaranteed early arrival and/or late departure (until 5pm) can be confirmed with a half day rental.
• Any arrival or departure between 6:30pm and 7am will incur an extra R 500 cash fee payable directly to the check-in staff.
9. Cancellation by Guest
Option 1: Refund
• 15% admin fee of the total booking will be retained, plus the Booking Fee.
• No refund if cancelled less than 2 weeks before arrival.
• The refund will be done via the same payment channel it was received.
• Refund request must be submitted in writing.
Option 2: Future Booking Credit
• Must be used within 1 year of the original date.
• Only one amendment to the travel date may be made.
• Booking may be moved to any other property managed by SeaSky Villas.
• All monies paid towards the original booking will be used to pay towards the next booking total cost, and the value of the2nd booking may not be less than the original booking.
• Not applicable if cancelled less than 2 weeks before arrival.
• The booking fee is non-refundable.
• Request for a future booking credit must be submitted in writing.
10. Alterations/Cancellations by Us
• Rare, but if unavoidable, we will:
o Refund in full or assist in finding comparable accommodation.
o Regardless of whether a substitution property is found, we will not be liable for cancellation charges for travel arrangements or any further claims by you or anyone else in your party.
o For the avoidance of doubt, in no event whatsoever and regardless of cause, shall the Agent or the Owner(s) of this property, or any other party associated with this rental transaction, have any liability for any cause whatsoever more than the amount that has been paid by the renter under this booking agreement, except as otherwise specifically required by Law.
11. Maximum Guests
• Only guests who are listed on this signed Conduct Agreement may be at the property.
• Excess occupants = immediate eviction.
12. Conduct & Noise
• Noise complaint = immediate eviction.
No noise or disturbance is allowed at any time, including shouting, music, loud bass, and revving cars.
Municipal bylaws apply at all times.
• No illegal drugs or excessive alcohol use is allowed.
The property manager may inspect the property if there’s a reasonable suspicion of a breach.
• Strictly no smoking indoors or within 3 meters of any open windows or doors. Ashtrays are provided for outside use. Smoking indoors will result in cleaning charges and immediate eviction.
• Hookah pipes are strictly prohibited anywhere on the property, including all outdoor areas and the garden.
• The villa is for accommodation only. No parties, events, gatherings are allowed. This includes DJs, musicians, event planners, etc.
• Only approved private chefs may be used. Please contact us if you’d like to arrange one of our pre-approved chefs.
• No external housekeepers, cleaners, servers or security staff are allowed at the property. If you need additional staff, kindly arrange this directly with us.
• A private security company may patrol during your stay.
If called out due to guest behaviour (e.g. noise), you will be liable for the cost.
13. Guest Responsibilities
• Pay for any losses or damages (beyond wear and tear) to the property’s premises.
• Keep property clean and secure. Alarm use is mandatory. ensure that the alarm is set, and all exterior doors and windows are closed every time the property is left unoccupied or when retiring for the night. Should there be a burglary and the alarm is not set, you will be held responsible for all replacement and repair costs.
• Permit the property manager reasonable access to the property.
• No subletting or unapproved visitors allowed. This will result in immediate eviction.
• Do not run any of the aircon units at the property for longer than 8 hours or set the temperature below 19 degrees Celsius, as this will cause the unit to freeze and cause damage. Any damages will be for your own account. Please ensure all aircons are switched off when leaving the property.
• Wind precautions. Please be very mindful of the extreme winds and wind gusts that often arise in this area (Cape Town/ Camps Bay). We ask that you bring all sun lounger cushions and any other items that may potentially blow away, inside when you see the wind picking up or when not in use. Should any of these items blow away and be lost due to being negligently left outside during a windstorm, you will be held liable and the replacement cost of these items. The same will be for any damages that are caused by leaving windows and doors open during a windstorm.
14. Breach of Contract
• Violations of this Conduct Agreement = termination of the booking agreement and immediate eviction + forfeiture of all payments.
• Security guards will be employed from the time of the notification to evict until all guests have vacated the property. The cost of these guards will be for your account.
15. Children
• This property does not allow any children under the age of 12 years old.
• Guests who choose to stay with children over the age of 12 years old, do so entirely at their own risk and are strongly advised to take all necessary precautions during their stay. The property owners and managers do not accept any responsibility for injuries or accidents that may occur.
16. Stairs
• The property contains stairs for access and/or within the premises. Guests acknowledge this and accept responsibility for assessing suitability. Any concerns must be raised with the property manager prior to booking.
17. Pets
• Strictly prohibited. Violation = immediate termination of the booking agreement + full cleaning/fumigation fees.
18. External Contractors
• Where applicable, we make use of the services of professional pool cleaners as well as a garden service. They have a regular visit routine, and the housekeeper or property manager will be able to give you details of the days they are due.
• These services are in place to make sure the property stays in good condition, our guests have come to appreciate and return to for their holiday. The days for service are all pre-arranged and cannot be changed.
• Should you refuse them access, you will be responsible for the cancellation fee.
19. Internet
• The wireless internet facility is free and uncapped/unlimited. It is at the fastest speed we currently have available in South Africa.
20. Load Shedding
• Load shedding or power outages are implemented when the demand for electricity in South Africa exceeds the available supply. The schedule for loadshedding works in stages, which can change frequently depending on the system load and each stage has different time slots. Load shedding usually lasts for about 2.5 hours but may vary depending on the stage (during the higher stages, some slots might be four hours long).
• To keep track of the load shedding schedule and receive updates, please download the Eskomsepush (ESP) app.
• Even though this property does have backup power, we do recommend the practical use of power during load shedding to conserve the battery life, especially if the power outage is going to be for longer than two ½ hours. Appliances such as heaters, clothes dryer, oven, vacuum, iron, hairdryer etc. will rapidly deplete the batteries.
• Selected lights, selected plugs and the WiFi will work during load shedding and the following appliances are not connected to the back-up batteries:
o Oven, however, there is a gas hob for cooking.
o Air Conditioner
o Geyser/HWC. If you should use all the hot water in the geyser just before or during loadshedding, it will take approximately 2 hours for the water to heat up again once the power comes back on.
• Unfortunately, load shedding is not something we can control, and we ask that you keep all your electronics fully charged and bring some extra batteries with you.
• Please note that we will not issue any refunds due to these possible inconveniences nor do we accept any responsibility for damage to any electronic equipment, suffered because of such load shedding.
21. Complaints
• Report issues immediately for resolution.
• We are not responsible for issues out of our control, such as failure of the water supply, electricity, telephone, and internet services, pool filtration, or any of the appliances. We also do not have control over building works on neighbouring villas, nor are we told before the time of intention to build.
• No post-departure claims accepted.
• If you vacate the property without notification during the rental period, you will lose any rights you might otherwise have had to compensation.
22. Property Descriptions
• Property descriptions and photos on our website or in promotional materials are provided in good faith and believed to be accurate. However, furnishings, decor, or property conditions may change and may not always reflect current availability. We are not liable for such discrepancies.
23. Disclaimer
• You shall have no claim for damages against the owner or the villa management company and may not withhold or delay any payment due to the owner or the villa management company, by reason directly or indirectly of:
• a breach by the owner or the villa management company of any of its obligations under this agreement.
• any act or omission of the owner or the villa management company or servant of or contractor to the owner or the villa management company, whether negligent, or otherwise actionable at law, and including (without limiting the generality of the foregoing) any act or omission of any cleaner, maintenance person, handyman, artisan, labourer, workman, watchman, guard, or commissionaire.
• the condition or state of repair at any time of the Property, the Building, or any part of the Property or the Building.
• any failure or suspension of, or any interruption in, the supply of water, electricity, gas, air-conditioning, heating, or any other amenity or service to the Premises, the Building, or the Property (including, without generality being limited, any cleaning service), whatever the cause.
• any breakdown of, or interruption in the operation of, any machinery, plant, equipment, installation, or system situated in or on, or serving, the Property, the Building, or the Premises, and including (but without limiting the generality of the foregoing) any lift, escalator, geyser, boiler, burglar alarm, or security installation or system, again regardless of cause.
• any interruption of or interference with the enjoyment or beneficial occupation of the Premises or any of the common parts of the Property or the Building caused by any building operations or other works to or in the building or elsewhere on or about the Property, whether carried out by the owner or the villa management company or by anybody else; or
• any other event or circumstance whatever occurring, or failing to occur, upon, in, or about the Property, the Building, or the Premises, whether the owner or the villa management company could otherwise have been held liable for such occurrence or failure,
• and you indemnify the owner or the villa management company against all liability to members of your household, your servants, guests, and other invitees, and all other persons who may occupy or be entitled to occupy the Premises or any parts thereof through or under you.
• the owner or the villa management company shall not, however, be excused from specific performance of any of its obligations under this lease, whether express or implied, and particularly (but not only) its obligations to afford you occupation and enjoyment of the Premises and the Furniture and contents as contemplated by this agreement and to carry out such maintenance and repairs as are incumbent upon the owner or the villa management company in terms hereof.
24. Liability
• We do not accept liability for any act, neglect or default for any accident, damage, loss, injury, expense, or inconvenience, whether to person or property, which any of the persons named on this agreement or any of their guests or invitees may suffer or incur arising out of, or in any way connected with, the property rental.
25. Insurance
• All guests are to arrange comprehensive insurance against travel and other related risks as any loss or damage, including theft of personal items, cannot be claimed against the property insurance. It is the responsibility of the guests named on the Agreement and those accompanying them to fully insure their personal items and to keep the property secured by setting any alarm and securing all doors, windows, and gates when going out.
26. Signing Authority
• All signatories confirm they:
o Are 18+ and authorized to agree to the terms of this Conduct Agreement.
o Accept responsibility for all guests.
27. No Lease Agreement
• No tenancy rights post-departure. That no lease agreement has come into effect between me and the owner of the property, that I shall have no right whatsoever, to remain on in the property after the period the property has been rented for by the client, expires, that the owner of the property may immediately seek my eviction from the property and that I will be held personally liable for all legal costs incurred by the owner of the property in such event, on a scale between attorney and client.
28. Governing Law
• South African law applies. South African law shall govern the validity, construction, and performance of these conditions. It is agreed between us, and the persons named on this agreement, that any dispute shall be subject to the exclusive jurisdiction of the South African Courts.
ACKNOWLEDGEMENT
I acknowledge and agree to all the clauses herein and understand that any violation of these terms may result in immediate eviction.
